Oqood in Dubai: escrow and how to check a project

What the Oqood entry is, where the money for an unbuilt project sits, and the public search, open to anyone, that returns the escrow account and the project's status.

The short answer

An entry in the interim register, and an account in the project's name

Oqood is the registration of an off-plan sale in Dubai's interim real property register: without it the sale is void. The money behind that sale sits in an escrow account opened in the name of the project, and both facts can be checked by the buyer, at no charge, before any money moves.

The two things are often confused. The register entry is about the contract — who bought which unit, recorded by the Department. The escrow account is about the money — where the instalments go and what the developer may draw from them.

The Department's project enquiry brings both into one screen: whether the project is registered, whether it has started, how far it has got, and which bank holds the account. A project whose entry you cannot find is a fact about the project, not about the search.

What registration costs, and what is held back

Entering the sale in the interim register is charged on the sale value; the escrow agent keeps a share of the account back for a year after the building is finished.

The developer's portal fee is often repeated as a buyer's cost. In the Department's own fees section it is the developer's self-registration fee, and we print it here as such.

The rules

What the escrow law requires of the developer

One account per project, opened in the project's name; no advertising without written authorisation; a retention after completion; and removal from the register for a developer that does not build.

The account is the project's, not the company's, which is why a developer with several projects cannot move money between them. If construction has not begun within 6Dubai law months of the permission to sell, and there is no acceptable reason, the Department can strike the developer from the register.

The parts of the check no document describes

The search itself is public and documented; two things around it are not, and one widely quoted fee belongs to somebody else.

Ask the seller for the project number and the escrow account, then check both against the Department's enquiry rather than against the brochure. The point of the exercise is that the answer comes from the register and not from the party selling to you.

Written permission to advertise is a requirement on the developer, not on the buyer. It is worth knowing all the same: an off-plan project being marketed to you is a project the Department has passed for marketing, and one that has not been is visible by its absence from the register.
